Throughout these Terms of Service, the terms “Camilla Rosales”, “we”, “us” and “our” refer to RENAVERO Renato Majarič s.p.
We operate the Camilla Rosales online store and website and provide related information, content, features, products and services (collectively, the “Services”).
Our online store is hosted and supported by Shopify.
These Terms of Service, together with our Privacy Policy, Return and Refund Policy, Shipping Policy and any other policies or notices published on our website, govern your use of the Services and purchases made through our online store.
By accessing our website, creating an account, placing an order or otherwise using the Services, you acknowledge that you have read and understood these Terms.
Nothing in these Terms excludes, restricts or limits any mandatory consumer rights that cannot legally be excluded or limited.
SECTION 1 – SCOPE AND ELIGIBILITY
Our online store is primarily intended for consumers located in Slovenia and other Member States of the European Union to which we make delivery available.
To place an order, you must have the legal capacity to enter into a binding contract under the law applicable to you.
You are responsible for ensuring that the information you provide when placing an order is accurate, complete and current.
If you create an account, you are responsible for maintaining the confidentiality and security of your login credentials and for activity carried out through your account.
You must notify us as soon as reasonably possible if you believe that your account has been accessed or used without authorisation.
SECTION 2 – PRODUCTS AND PRODUCT INFORMATION
We make reasonable efforts to ensure that product descriptions, photographs, specifications, sizes, colours, materials and other information displayed on our website are accurate and up to date.
However, the appearance of products may vary slightly from photographs displayed online.
In particular, colours may appear differently depending on the screen, display settings, lighting conditions, photography and device used to view the website.
Minor variations may also occur between individual products or production batches, including variations in:

Nothing in this section limits your statutory rights where a product materially differs from its description, does not possess the agreed characteristics, is defective, unsafe or otherwise fails to conform to the contract.
SECTION 3 – MATERIAL COMPOSITION
The material composition applicable to a particular product is stated on the relevant product page, product label, packaging or accompanying information as required by applicable law.
Customers should review the material composition and relevant product information before purchasing and before wearing the product.
Material composition may vary between different products, collections, colours or models. Customers should therefore not assume that the composition of one Camilla Rosales product is identical to another.
Where there is an apparent discrepancy between the material information provided online and information provided on the product label or packaging, please contact us at info@camillarosales.com before continued use of the product.
We do not represent or guarantee that a product is hypoallergenic, allergy-free, nickel-free, latex-free or suitable for particularly sensitive skin unless such characteristic is expressly stated in the description of the specific product.
SECTION 4 – SKIN SENSITIVITY, ALLERGIES AND INDIVIDUAL REACTIONS
Textiles and garments come into prolonged and direct contact with the skin. Individual sensitivity to materials may vary significantly from person to person.
Depending on the specific product, garments may contain or come into contact with textile fibres, dyes, elastic materials, finishing substances, threads, decorative elements, adhesives, labels or metal components.
A material that causes no reaction in most users may cause irritation, sensitivity or an allergic reaction in a particular individual.
Customers with known allergies, skin sensitivities, contact dermatitis, sensitivities to particular textile fibres, dyes, metals or other materials should carefully review the product composition and product information before purchase and use.
If you are uncertain whether a product is suitable for you, please contact us before purchase for available product information.
If irritation, redness, itching, swelling, discomfort, rash or another unexpected skin reaction occurs, discontinue use of the product.
Where reasonably appropriate and permitted by the care instructions, washing a garment before prolonged first use may also remove ordinary manufacturing, packaging or handling residues.
Camilla Rosales does not guarantee that any product will be suitable for every individual skin type or sensitivity unless expressly stated otherwise.
To the extent permitted by applicable law, an individual reaction or sensitivity does not in itself establish that a product is defective or non-conforming where the product is safe, complies with applicable requirements, accurately states its material composition and the reaction results solely from an individual's particular sensitivity.
Nothing in this section excludes or limits our responsibility for an unsafe, defective, incorrectly labelled or otherwise non-conforming product, or any other liability that cannot legally be excluded.
SECTION 5 – METAL AND DECORATIVE COMPONENTS
Certain products may contain hooks, rings, adjusters, fasteners, chains, decorative pieces or other components made from or containing metal or other materials.
Customers with known sensitivity or allergy to particular metals or materials should review the relevant product information and contact us before purchasing if additional information is required.
Decorative elements and delicate components should be handled carefully.
Damage resulting from excessive pulling, bending, snagging, crushing or other inappropriate handling does not constitute a product defect where the product was otherwise conforming at the time of delivery.
Nothing in this section affects statutory rights relating to unsafe or non-conforming products.
SECTION 6 – SIZING AND FIT
Any size chart, fit recommendation or measurement information provided on our website is intended to assist customers in choosing a suitable size.
The fit of lingerie and clothing may vary depending on:

individual preference;

product design and cut;

elasticity of the material;
-
construction of the garment;
-
differences between styles and collections.
A size recommendation or size chart therefore cannot guarantee that a particular size will provide the customer's preferred fit.
Customers are responsible for reviewing the applicable size information before ordering.
Ordering an unsuitable size does not in itself mean that the product is defective or non-conforming.
Eligible products may be returned in accordance with our Return and Refund Policy and applicable consumer law.
For hygiene reasons, customers should retain all hygiene protections while determining whether an intimate product is suitable.
SECTION 7 – CARE, WASHING AND PROPER USE
Customers must follow the care, washing, drying, ironing and other instructions supplied with the product or shown on its label.
Lingerie and delicate garments may contain fine lace, embroidery, elastic materials, underwires, straps, hooks or decorative components that require appropriate care.
Damage or deterioration resulting from incorrect care or use may include, without limitation:

washing at an unsuitable temperature;

use of bleach or unsuitable chemicals;
-
tumble drying where prohibited by the care instructions;
-
inappropriate ironing;
-
washing with sharp or abrasive items;
-
excessive stretching;
-
snagging;
-
improper storage;
-
alteration of the product;
-
failure to follow the product care instructions.
Normal wear and tear, gradual loss of elasticity resulting from ordinary use, damage caused by external objects, improper washing, misuse or failure to follow care instructions does not in itself constitute a lack of conformity.
This section does not affect your statutory rights where deterioration or damage results from an inherent product defect or lack of conformity.
SECTION 8 – PRODUCT SAFETY
Products must only be used for their normal and intended purpose and in accordance with any instructions or warnings supplied with the product.
Do not continue to use a product if it becomes damaged in a manner that may make continued use unsafe.
Where a product contains detachable, sharp, metallic or decorative components, appropriate care should be taken to prevent injury or damage.
Product-specific warnings, manufacturer information, importer information, identification information and other safety information will be made available where required by applicable law.
Where RENAVERO Renato Majarič s.p. imports products directly into the European Union from a manufacturer established outside the European Union, RENAVERO Renato Majarič s.p. acts as the importer where applicable under EU law.
We may contact customers where reasonably necessary in connection with a safety notice, corrective measure, product withdrawal or recall.
Nothing in these Terms limits any obligations imposed by applicable product safety legislation.
SECTION 9 – ORDERS AND FORMATION OF CONTRACT
Products displayed on our website constitute an invitation to place an order and do not necessarily constitute a binding offer by us.
By submitting an order, you make an offer to purchase the selected products.
After submitting your order, you may receive an automatic confirmation acknowledging that we have received it.
We reserve the right to refuse an order before acceptance for legitimate reasons, including:

inability to authorise payment;

suspected fraud or unauthorised activity;

incorrect or incomplete delivery information;

obvious or manifest pricing errors;

Where payment has already been collected for an order that we lawfully cannot accept or fulfil, the relevant amount will be refunded.

SECTION 10 – PRICES, VAT AND PAYMENT
Unless clearly stated otherwise, prices displayed to consumers on our online store are shown in euros (EUR) and include VAT where applicable.
Any applicable delivery costs or other additional charges will be displayed before the customer submits an order where required by law.
The final amount payable will be shown during checkout before the order is placed.
We may change product prices at any time. A price change will not affect an order for which a binding contract has already been concluded, except where permitted by applicable law.
Promotional prices, discount codes and special offers may be subject to additional conditions and validity periods.
We reserve the right to correct obvious typographical or technical pricing errors. Where an obvious error is identified before an order is accepted, we may refuse the order and invite you to place a new order at the correct price.
Payment methods available at checkout may vary.
You represent that you are authorised to use the payment method provided for the purchase.
Payment services may be processed by third-party payment providers subject to their own terms and privacy practices.
SECTION 11 – PRODUCT AVAILABILITY
All orders are subject to product availability.
Stock information is updated regularly, but errors or simultaneous purchases may occasionally cause a product shown as available to become unavailable.
If we are unable to supply an ordered product, we will notify you and refund any amount paid for that product without undue delay where required.
Product lines, designs, colours, sizes and collections may be modified or discontinued at any time.
SECTION 12 – SHIPPING AND DELIVERY
Available shipping options, delivery destinations, estimated delivery times and shipping charges are displayed during checkout or in our Shipping Policy.
Delivery times are estimates unless a specific delivery date has been expressly agreed.
Occasional delays may occur due to circumstances outside our reasonable control, including carrier disruption, severe weather, strikes, customs procedures where relevant, public emergencies or other exceptional circumstances.
This does not affect any statutory rights that arise where delivery is delayed.
For consumer orders where we arrange delivery, the risk of accidental loss of or damage to the goods generally remains with us until you, or a third party designated by you other than the carrier, physically receives the goods.
Where you independently commission a carrier that was not offered by us, different rules regarding transfer of risk may apply in accordance with applicable law.
Please inspect the parcel reasonably promptly after delivery and contact us if it arrives visibly damaged or if products are missing.
Failure to report visible damage immediately does not remove any mandatory statutory rights.
SECTION 13 – RIGHT OF WITHDRAWAL, RETURNS AND REFUNDS
Consumers purchasing online generally have a statutory right to withdraw from the contract within 14 days, subject to conditions and exceptions provided by applicable law.
Detailed information regarding returns, hygiene protections, return costs, refunds and the procedure for exercising the right of withdrawal is provided in our Return and Refund Policy, available on our website.
Because we sell lingerie and intimate garments, certain products may be supplied with a hygiene protection strip or hygiene seal.
Where a product is sealed for genuine health protection or hygiene reasons and is not suitable for return once the hygiene protection has been opened, removed, broken or damaged, the statutory hygiene exception may apply in accordance with applicable law.
Customers should therefore inspect the size, appearance and other characteristics of an intimate product without removing or damaging its hygiene protection until they have decided to keep the item.
Camilla Rosales does not offer direct exchanges for another size, colour or model.
Where a return is permitted, customers may return the original eligible item in accordance with our Return and Refund Policy and place a new order separately.
SECTION 14 – CONFORMITY, DEFECTIVE GOODS AND STATUTORY RIGHTS
Consumer purchases are protected by mandatory statutory rights relating to conformity of goods.
We are responsible for lack of conformity in accordance with applicable consumer protection law, including where a product:

does not possess agreed characteristics;

is not suitable for its normal purpose;

is materially different from what was agreed;

is defective or unsafe;

does not meet other mandatory conformity requirements.
For consumer sales subject to Slovenian and applicable EU consumer law, the statutory period of seller liability for lack of conformity is generally two years from delivery, without prejudice to any more favourable mandatory rights applicable to the consumer.

Nothing in our Return and Refund Policy, these Terms or any other policy limits remedies available to consumers under mandatory law.
SECTION 15 – NORMAL WEAR, MISUSE AND CUSTOMER-CAUSED DAMAGE
A product is not necessarily defective merely because it shows deterioration resulting from ordinary use and expected wear.
To the extent permitted by applicable law, we are not responsible for damage caused after delivery by circumstances including:

use contrary to supplied instructions;

inappropriate washing or drying;

improper storage;
-
accidental damage;
-
deliberate damage;
-
modification or repair by the customer or a third party;

excessive stretching or pulling;
-
contact with sharp or abrasive objects;

misuse of fasteners, straps, lace or decorative elements;

use of inappropriate chemicals, detergents or cosmetics.
Each claim will be assessed according to the circumstances and applicable consumer law.
Nothing in this section excludes responsibility for an inherent defect or lack of conformity that existed at the relevant time under applicable law.
SECTION 16 – PHOTOGRAPHS, DIGITAL REPRESENTATIONS AND CONTENT
We make reasonable efforts to display products accurately.
However, photographs and digital representations may differ slightly from the physical product due to lighting, photography, image processing, screen technology, screen calibration and device settings.
Images may also show products styled with accessories or other items that are not included in the purchase unless expressly stated.
The written product description and the contents specifically identified as included in the product or set determine what is included in the purchase.
Material differences between the product supplied and the agreed product description remain subject to applicable consumer rights.
SECTION 17 – WEBSITE ERRORS AND INACCURACIES
Occasionally, our website may contain typographical errors, technical errors, inaccuracies or omissions relating to product information, availability, prices, promotions, shipping or other information.
We reserve the right to correct such errors and update information.
Corrections will not deprive customers of rights arising from an already concluded contract except where applicable law permits otherwise.
If an error materially affects an order, we will contact the customer where appropriate.

Unless otherwise stated, the content of the Camilla Rosales website, including its name, branding, logos, graphics, photographs, videos, text, product descriptions, designs, layout and other original material, is owned by or licensed to RENAVERO Renato Majarič s.p. and is protected by applicable intellectual property law.
The website and its content may be used for personal and non-commercial purposes only.

Nothing in this section permits us to misrepresent customer reviews or engage in misleading commercial practices.

The Camilla Rosales online store is powered by Shopify.
Shopify provides the e-commerce infrastructure that enables us to operate the online store.
Purchases made through the Camilla Rosales store are contracts between the customer and RENAVERO Renato Majarič s.p., not between the customer and Shopify.
Shopify may process certain information in connection with the operation of the website and online store in accordance with applicable privacy rules and Shopify's own privacy practices.

SECTION 23 – PRIVACY AND PERSONAL DATA
Personal information collected through the Services is processed in accordance with our Privacy Policy and applicable data protection law.

This section does not remove any right to cancellation, reimbursement or other remedy that the customer has under mandatory applicable law.

We reserve the right to investigate suspected fraud, abuse or manipulation involving orders, payments, discount codes, returns, refunds, hygiene protections or customer accounts.

Termination of website access does not affect payment obligations or contractual and statutory rights arising from purchases already made.

SECTION 28 – OUT-OF-COURT CONSUMER DISPUTE RESOLUTION
We encourage customers to contact us first if they have a complaint so that we can attempt to resolve the matter directly.

In accordance with the Slovenian rules on out-of-court resolution of consumer disputes, RENAVERO Renato Majarič s.p. does not recognise any provider of out-of-court consumer dispute resolution (IRPS) as competent to resolve a consumer dispute that a consumer may initiate, except where participation in such a procedure is mandatory under applicable law.
This does not restrict the consumer's right to seek protection through competent courts, public authorities or other mechanisms available under applicable law.
SECTION 29 – GOVERNING LAW AND JURISDICTION
These Terms and contracts concluded through the Camilla Rosales online store are governed by the laws of the Republic of Slovenia, subject to mandatory provisions of European Union law and applicable consumer protection law.
If you are a consumer habitually resident in another country, this choice of law does not deprive you of mandatory consumer protection afforded to you by provisions of the law of your country that cannot be derogated from by agreement.
Nothing in these Terms restricts any mandatory rules determining which courts have jurisdiction over consumer disputes.
SECTION 30 – SEVERABILITY
If any provision of these Terms is found to be invalid, unlawful or unenforceable, that provision will apply only to the maximum extent legally permitted.
Where necessary, the invalid or unenforceable part will be treated as severed without affecting the validity of the remaining Terms.
Mandatory law will prevail over any inconsistent provision of these Terms.
SECTION 31 – NO WAIVER
If we do not immediately exercise or enforce a right available to us under these Terms or applicable law, this does not mean that we waive that right.
A waiver relating to one particular circumstance does not constitute a waiver relating to any future circumstance.

Changes will generally apply prospectively.
Changes to these Terms will not retroactively reduce contractual or statutory rights arising from an order already concluded, except where permitted or required by applicable law.
